1. PURCHASES ON THE SITE
1.1 With reference to Italian citizens, sales on the Site are reserved only for those who are at least 18 years old. A buyer who is not an Italian citizen can purchase Products on the Site only if they are of legal age according to their national law. If there is no legislation regarding this, they must be at least 21 years old.
In any case, the user making purchases on the Site agrees to indemnify Garda&Vino from any liability in the event that they have made purchases on the Site without respecting their national law regarding age purchase limits.
1.2 Garda&Vino reserves the right to refuse or cancel orders coming from (i) a user with whom it has an ongoing legal dispute; (ii) a user who has previously violated these General Conditions of Sale and/or the terms and/or conditions of a purchase contract with Garda&Vino; (iii) a user who has been involved in any type of fraud, particularly fraud related to credit card payments; (iv) users who have provided false, incomplete, or otherwise inaccurate identification data or who have not promptly sent Garda&Vino the documents requested by these General Conditions of Sale or who have sent invalid documents; (v) users who do not provide sufficient guarantees of solvency. In any case, Garda&Vino reserves the right to cancel orders related to transactions that do not present an absolute degree of genuineness.
1.3 Regarding purchases on the Site, it may occur that: the purchase procedure contains one or more material errors; the Product Sheet, as defined below, contains incorrect information due to material errors (e.g.: the price of the Product, the vintage of the Product); due to a material error, a Product is indicated as available but is not at the time of order preparation. In these cases, or in similar cases, the user may request the cancellation of the order or obtain, in agreement with Garda&Vino, a different Product, possibly with an adjustment related to the purchase cost.
2. REGISTRATION ON THE SITE
2.1 Purchasing Products on the Site is allowed only to registered users.
2.2 The registration credentials must be used exclusively by the user and cannot be transferred to third parties. The user agrees to keep them confidential and to ensure that no one has access to them, as well as to promptly inform Garda&Vino in case of suspected misuse and/or disclosure of them. The user guarantees that the personal information provided during the registration process on the Site is complete and truthful. The user agrees to hold Garda&Vino harmless from any damage, liability, and/or sanction arising from and/or in any way related to the user's violation of the registration rules on the Site or the preservation of the registration credentials.
3. PRICES and OMNIBUS DIRECTIVE (Legislative Decree No. 26 of March 7, 2023)
3.1 All product prices are expressed in Euros (€) and are intended to include Value Added Tax ("VAT"), unless otherwise stated. Any additional cost will be expressly and separately indicated in the order form, before the user proceeds to submit the same.
3.2 The price of the Products may be modified by Garda&Vino at any time, without notice, provided that the price charged to the user will be the one published on the information sheet that illustrates the main characteristics of the Product (Product Sheet) at the time of order submission. Any variations (increases or decreases) in price after the order has been submitted will not be taken into account.
If, following generalized price reductions, such as the so-called Black Friday, Garda&Vino decides to launch a new promotion on individual products, such new promotion will take place without interruption, always indicating the base price as a reference value for the discount (corresponding to the lowest price of the 30 days preceding the application of the first announcement of the price reduction (e.g., Black Friday).
Garda&Vino also offers personalized promotions through specific discount vouchers (coupons) for individual customers or for homogeneous groups of customers, allowing them to benefit from a discount on the price of all products or on specific ranges of products for continuous (even extended: e.g., 1 year) periods or for single purchases.
4. Products Section
4.1 Each Product is accompanied by a Product Sheet. The images and descriptions on the Site reproduce as faithfully as possible the characteristics of the Products. The images of the Product present in the Product Sheet may also differ by vintage and/or size or in relation to any accessory products. Therefore, these images should be understood as indicative and with tolerances for use. For the purposes of the purchase contract, the description of the Product contained in the order form transmitted by the user will prevail.
4.2 All Products contain sulfites, as the very process of wine production implies the presence of sulfites in it. However, it is possible that during the wine production process additional sulfites are added; in some cases, however, it is possible that a wine does not contain "added" sulfites.
4.3 The purchase of gift vouchers does not affect the payment threshold which, once exceeded, grants the user the right to obtain free shipping of the Products.
5. PRODUCT AVAILABILITY
5.1 The products offered on the Site are in limited quantity. Therefore, it may happen, also due to the possibility that multiple users purchase the same Product simultaneously, that the ordered Product is no longer available after the transmission of the purchase order.
